RE: Formal Complaint of Corporate Misconduct, Retaliation, Discrimination (Title VII), Perjury, and Deceptive Business Practices by Exegy, Inc. and Associated Counsel

Dear [Agency Name, e.g., Missouri Attorney General's Office],

This letter serves as a formal complaint detailing a pattern of corporate misconduct, employment discrimination, and judicial manipulation perpetrated by Exegy, Inc., its CEO David Taylor, and its legal counsel, including Patrick Sellers, Robert Earles (Cooley LLP), and Tina Babel (Carmody MacDonald P.C.). These actions are related to an ongoing civil lawsuit filed by Exegy, Inc. against me in Missouri, Case No. [Insert Case Number, e.g., 25SL-CC09400].

The purpose of this complaint is to bring the following severe violations to your attention for investigation and appropriate action under relevant Missouri statutes and federal law (including Title VII of the Civil Rights Act of 1964).

I. Judicial Manipulation, Perjury, and Destruction of Evidence

Exegy, Inc. is actively using the Missouri courts to perpetuate fraud, retaliate against me, and destroy evidence relevant to the underlying disputes.

A. Fraudulent Affidavit and Perjury

  1. Exegy CEO David Taylor submitted a false and manipulative affidavit to the Circuit Court of St. Louis County to obtain a Temporary Restraining Order (TRO) against me.

  2. The affidavit contains numerous material misrepresentations regarding my previous work performance, which is contradicted by my actual employment history, raises, bonuses, and managerial assignments (see Section III.A).

  3. I notified Exegy’s legal team (Robert Earles/Bobby Earles, Tina Babel, and Patrick Sellers) several weeks ago that their client, David Taylor, had submitted a materially false affidavit. Despite this, they have failed to notify the courts of the falsehoods, effectively assisting in the manipulation of the judicial process.

B. Illegality and Evidentiary Destruction via Temporary Restraining Order (TRO)

  1. The TRO, obtained based on the fraudulent affidavit, is illegally broad and appears designed to suppress relevant fact witnesses and destroy evidence.

  2. The TRO attempts to destroy evidence by forcing the removal of social media posts, which may contain or reference information and evidence related to the underlying lawsuit and this complaint.

  3. The TRO unlawfully restricts my communication with Exegy employees (many of whom are my friends and fact witnesses) and customers, thereby obstructing justice and preventing me from gathering evidence or seeking information related to the company’s actions (including the alleged bounty program and potential customer network vulnerabilities).

  4. The restrictions on communication and speech likely violate my constitutional rights and are a form of illegal judicial overreach to silence a victim and conceal corporate wrongdoing.

II. Retaliation and Invasion of Employee Privacy

Exegy, Inc. has engaged in clear retaliation following my communication regarding their lawsuit and business practices.

  1. Work Performance Falsification: Exegy Inc. and its in-house attorney Patrick Sellers have repeatedly made false statements to the courts and to the Illinois ARDC regarding my work performance, stating I was "average to below average" and referencing a negative "history with Exegy," which is verifiably false. This is a clear retaliatory tactic designed to discredit me.

  2. Invasion of Employee Privacy: Exegy, Inc. sent an email to all employees, essentially ordering them to cease communication with me and to turn over any attempts at correspondence.

  • This is an unwarranted invasion of employee privacy, especially since I communicated with these individuals (many of whom are friends) solely via their personal devices on non-Exegy matters.

  • This directive has resulted in many of my friends refusing to communicate with me even on non-Exegy-related subjects, demonstrating Exegy’s coercive control over its employees’ private lives.

  1. Coercion and Harassment of Employees: The company is effectively coercing current employees, who are fact witnesses in the ongoing dispute, from cooperating with me by making communication a fireable offense.

III. Employment Discrimination (Title VII & Missouri Labor Law)

This complaint alleges violations of Title VII of the Civil Rights Act of 1964 and Missouri labor law concerning discrimination and unfair labor practices.

  1. Discrimination in Layoffs (Title VII): Exegy, Inc. has a history of laying off employees in Missouri to favor the hiring and retention of people in the Philippines due to their "cheap compensation." This practice raises serious concerns regarding discrimination based on national origin or race and warrants a full investigation under Title VII jurisdiction.

  2. Unfair Compensation and Excessive Workload: Despite performing at an above-average level and taking on multiple roles due to the company's failure to hire replacements (as detailed in the attached document, 19.docx), I was denied appropriate compensation and time off for burnout. The company forced me and others in my group to take on responsibilities from unfilled positions (ASG, Operations), constituting unfair labor practices.

IV. Deceptive Business Practices and Fraud (Missouri Attorney General & FBI IC3)

This section details ongoing attempts by Exegy, Inc. to deceive me and potentially the public.

  1. Deceptive Bounty Program/Theft: Exegy's in-house attorney, Patrick Sellers, stated to the Illinois ARDC that the company reserves the right to not pay out on genuine bounties. This suggests the company intended to use deceptive terms and conditions to rob people of their intellectual property or findings, which I believe is an actionable deceptive trade practice and relates to my existing FBI IC3 complaint of conspiracy to commit robbery.

  2. Failure to Negotiate in Good Faith: Exegy’s CEO lied to the courts by stating I declined their offer without mentioning my specific request: that the offer must address and protect me and my property from theft, and that a confidentiality agreement alone would only serve to protect the company. Exegy refused to provide a copy of the proposed confidentiality agreement or any other contract, indicating a lack of good faith.

  3. Extortion Claim Fabrication: Exegy’s CEO lied to the courts by claiming I attempted to extort the company. My actual statement was: “I would like to talk, if not I will move to trying to talk with your customers and seeing if they have a bounty program and give me time about the things that could affect their network.” This statement was a legitimate effort to engage with customers about network vulnerabilities or bounty programs, and was manipulated by Exegy to conceal information from their customers.

  4. Improper Use of Legal Name/Fictitious Name: Robert Earles of Cooley LLP refused to provide his legal registered name for the Illinois Bar, instead using the fictitious name "Bobby Earles" to electronically sign documents. This may constitute professional misconduct and deceptive practice.

  5. PPP Loan Fraud Concern: I believe Exegy, Inc. may have fraudulently obtained a PPP loan. As a company serving financial institutions and classified as part of the infrastructure, they did not lose business, and in fact hired people the previous year and during the loan year, suggesting they did not meet the criteria for need. This warrants investigation.

  1. I have filed two separate complaints against Exegy, Inc. with the FBI IC3 regarding Extortion and Conspiracy to Commit Robbery.

  2. The attorneys involved in the civil lawsuit against me, and whose conduct is subject to this complaint, are:

  • Robert Earles (aka Bobby Earles) at Cooley LLP

  • Tina Babel at Carmody MacDonald P.C.

  • Patrick Sellers (In-House Counsel) at Exegy Inc.

  • Az Virji at Marlin Equity Partners (believed to be involved)

I request that your office initiate an immediate, thorough investigation into the actions of Exegy, Inc., its CEO David Taylor, and its named legal counsel for the violations outlined above, particularly focusing on the use of perjury to manipulate a court-issued Temporary Restraining Order.

I am prepared to provide all supporting documentation, including the CEO’s affidavit, my performance records, communications with Exegy legal counsel, and details of the FBI IC3 complaints.

Sincerely,

Justin Walters
